Please read these Terms of Service ("Terms") carefully before using the Pre PG: MCQ Practice App mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to all of these Terms, you must immediately cease all use of the App and delete it from your device.
1. Acceptance of Terms
By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Pre PG: MCQ Practice App. Your continued use of the App following any modification to these Terms constitutes acceptance of the modified Terms. If you do not agree, please do not use the App.
2. Description of Service
Pre PG: MCQ Practice App is an educational mobile application designed to help medical students prepare for postgraduate entrance examinations through:
- Multiple Choice Question (MCQ) practice and revision.
- Subject-wise study with offline capability.
- Weekly mock test series with All India Ranking.
- Progress tracking, analytics, and streak monitoring.
- Community discussion forums.
- Ad-supported free access with optional ad-free purchase.
- AI-powered study assistant (LEXA) for personalized learning.
3. User Accounts
To access the App, you must register using a valid Indian mobile phone number and verify it via One-Time Password (OTP). You are responsible for:
- Providing accurate and truthful registration information.
- Maintaining the confidentiality and security of your account credentials.
- All activities that occur under your account, whether or not authorised by you.
- Notifying us immediately of any unauthorised use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or compromise the integrity of the platform.
4. Educational Use Disclaimer
This App is provided for educational, revision, and self‑assessment purposes only. Unless expressly stated otherwise, the App is not affiliated with, endorsed by, or sponsored by any examination authority, university, publisher, coaching institute, or content owner.
The content provided in the App, including questions, answers, explanations, and study material, is compiled for educational reference and self-assessment. While we endeavour to ensure accuracy, we make no warranty or guarantee that any content is free from errors, complete, current, or aligned with any specific examination syllabus or pattern.
5. No Guarantee of Examination Results
We expressly disclaim any guarantee, warranty, or representation that use of the App will result in success in any examination, entrance test, or academic assessment.
Examination performance depends on numerous factors beyond the scope of this App, including but not limited to individual preparation, study habits, prior knowledge, examination conditions, syllabus changes by examining bodies, and other external factors. You acknowledge and agree that:
- The App is a supplementary study tool and should not be relied upon as the sole preparation resource.
- You are solely responsible for your examination preparation and results.
- We shall not be liable for any loss, disappointment, or damage arising from examination outcomes.
6. Medical Disclaimer
The content in this App is intended solely for educational and examination preparation purposes. It does NOT constitute medical advice, clinical guidance, diagnostic opinion, or treatment recommendation.
No content in the App should be used for clinical decision-making, patient care, or any real-world medical practice. The questions and explanations presented may be simplified, paraphrased, or adapted for examination preparation and may not reflect the full complexity of clinical medicine. Users who are practising clinicians must rely on their own clinical judgement, current medical literature, and institutional protocols for all patient care decisions. We disclaim all liability for any consequences arising from the use of App content in a clinical or patient-care setting.
7. Content Originality, Ownership, and Right to Modify
The App functions as a platform for hosting, organising, and presenting educational content contributed by community members, educators, and users. The selection, coordination, arrangement, and technological presentation of content represent our original editorial and platform effort.
All questions, answers, explanations, and study materials available in the App are contributed by community members and educators through the App's content submission mechanisms. We do not independently author, verify the originality of, or endorse any specific question, answer, or explanation. Contributors are solely responsible for ensuring that their submissions do not infringe any third-party intellectual property rights.
Where any content may relate to concepts, topics, or subject matter covered in standard educational curricula or publicly known medical knowledge, such content reflects the contributor's own formulation and expression for educational and self-assessment purposes.
We reserve the unconditional right to add, modify, replace, correct, update, or permanently remove any content from the App at any time and for any reason, including but not limited to upon receipt of a copyright complaint, without prior notice to users and without any obligation to provide replacement content. No user shall have any claim, right, or entitlement to the continued availability of any specific question, answer, explanation, or other material in the App.
8. Test Series & Daily Tests
The App offers competitive testing features:
8.1 Weekly Test Series
The weekly Test Series is subject to the following rules:
- Tests are conducted every Sunday from 6:00 PM to 7:00 PM IST.
- Each test consists of 100 MCQs (5 from each of 20 subjects) with a 60-minute time limit.
- Scoring: +2 for correct answers, −1 for incorrect answers, 0 for unanswered.
- All participants receive the same set of questions for each test.
- The test auto-submits when the timer expires.
- Rankings are computed after a 30-minute grace period to accommodate connectivity delays.
- Leaderboard displays your name and last 4 digits of your phone number.
- Any attempt to manipulate test timing, scores, or rankings may result in immediate disqualification, permanent account suspension, and potential legal action.
8.2 Daily Tests
The App also offers daily tests subject to the following rules:
- A fresh 50-question test is available daily at 9:00 PM IST.
- Each test has a 40-minute time limit.
- All India Ranking is published at 10:00 PM IST.
- The same rules regarding scoring, fair play, and leaderboard display as the Weekly Test Series apply.
8.3 Custom Tests
Users may create personalised tests by selecting specific subjects. Custom tests consist of up to 100 MCQs and are subject to the same scoring methodology as the Weekly Test Series.
9. Advertising
The App is free to use and supported by advertisements served by Google AdMob. By using the App, you agree to the following:
- Ad Display — Interstitial and rewarded video advertisements may be displayed during your use of the App, including between quiz questions, before accessing certain features, and when the App resumes from the background.
- Ad Personalisation — Google AdMob may use device identifiers and usage data to serve personalised advertisements. You can opt out of personalised ads through your device's privacy settings (iOS: Settings → Privacy → Tracking; Android: Settings → Google → Ads).
- Third-Party Ad Networks — Advertisements are served by Google AdMob and its mediation partners. These third parties may collect data in accordance with their own privacy policies. See Google's Privacy Policy for details.
- Rewarded Ads — Certain features (e.g., Test Series, Review Previously Solved Questions) require watching a rewarded video advertisement before access is granted.
- Ad Blockers — Use of ad-blocking software or network-level ad blocking while using the App may result in restricted access to certain features.
10. Ad-Free Purchase & Payments
The App offers a one-time "Remove All Ads" purchase:
- Payment Processing — All payments are processed securely by Razorpay, our third-party payment gateway. We support UPI, debit cards, credit cards, and net banking. We do not store your payment card or UPI credentials on our servers.
- Pricing — The ad-free purchase price is displayed in Indian Rupees (INR) and is inclusive of all applicable taxes. We reserve the right to change the price at any time without prior notice.
- Ad-Free Status — Once purchased, all interstitial and rewarded ads are permanently removed from your account. This status is tied to your account and persists across devices.
- Non-Refundable — The ad-free purchase is final and non-refundable, except where required by applicable law or in cases of duplicate charges or verified payment processing errors.
- Failed Transactions — If a payment is deducted but the ad-free status is not granted due to a technical failure, please contact us with your transaction details and we will resolve the issue within 48 hours.
11. Referral Programme
The App offers a referral programme that rewards users for inviting new users:
- Each user receives a unique referral code that can be shared with others.
- When a new user registers using your referral code, both the referrer and the new user may receive bonus benefits as specified in the App.
- Referral bonuses are subject to change at our discretion without prior notice.
- Abuse of the referral system, including creating multiple accounts, self-referrals, or fraudulent referrals, will result in forfeiture of all bonuses and potential account suspension or termination.
- We reserve the right to cap, modify, or discontinue the referral programme at any time.
12. LEXA — Study Assistant
The App includes an AI-powered study assistant ("LEXA") that helps users understand medical concepts, explain MCQ answers, and clarify topics relevant to PG entrance exam preparation. By using LEXA, you agree to the following:
- Nature of Service — LEXA is an educational tool designed to assist with medical academic queries. It is not a substitute for textbooks, clinical training, or professional medical advice.
- Cost — LEXA is free to use. Each session includes unlimited messages within that conversation.
- Accuracy — While LEXA strives to provide accurate and helpful information, AI-generated responses may occasionally contain errors. Users are encouraged to verify critical information with authoritative sources.
- Limitations — LEXA is restricted to medical academic topics relevant to PG entrance exams. It will not provide personal, legal, financial, or non-medical advice.
- Data Usage — Conversations with LEXA may be stored for service improvement purposes. No personally identifiable information is shared with third-party AI providers beyond what is necessary to generate responses.
- Availability — LEXA availability is subject to server capacity and third-party API availability. We do not guarantee uninterrupted access to this feature.
13. AI-Generated Content & Text Highlighter
The App provides AI-generated educational content and text annotation tools:
- AI Content Tabs — After answering an MCQ, the App may display AI-generated educational content including "Detailed Discussion", "Clinical Points", and "Exam Pearls". This content is generated by third-party AI services and cached for future retrieval. It is provided for educational reference only and may contain errors.
- Text Highlighter — Users may highlight and annotate AI-generated content using the built-in text highlighter tool. Highlights are saved to your account and synchronised across sessions.
- Flashcards — The App generates AI-powered flashcards from topics you study. These are stored in your account for swipe-based revision. Flashcard content is auto-generated and may occasionally contain inaccuracies.
- Caching & Storage — AI-generated content is cached on our servers to reduce response times and AI service costs. Cached content may be updated, corrected, or removed at any time without notice.
- No Medical Reliance — All AI-generated content (including discussions, clinical points, exam pearls, and flashcards) is for educational and revision purposes only. It must NOT be used for clinical decision-making or patient care.
14. Content Reporting and User Safety
To maintain a safe and respectful community, the App provides content moderation tools:
- Reporting — You may report forum posts, comments, or user content that you believe violates our guidelines or is inappropriate, offensive, or harmful. Reports are reviewed and actioned by our moderation team.
- Blocking — You may block other users to prevent them from interacting with you in community features. Blocked users will not be able to see your forum posts or comments.
- MCQ Reporting — You may report MCQs that you believe contain incorrect answers or information. Reported questions are reviewed by our editorial team.
- Moderation Actions — We reserve the right to remove content, issue warnings, restrict access, or permanently ban users who violate our community guidelines or these Terms.
- False Reports — Submitting repeated false or malicious reports may result in your own account being restricted or terminated.
15. Single-Device Login Policy
For security and to prevent unauthorised account sharing, only one device may be logged into your account at any time. When you log in on a new device, any existing session on a previous device is automatically terminated. You acknowledge and agree that:
- Account credentials must not be shared with other individuals.
- Each account is for personal use by a single individual.
- We may detect and restrict suspicious login patterns indicative of account sharing.
16. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to tamper with, reverse-engineer, decompile, disassemble, or circumvent any technical or security features of the App.
- Share, redistribute, reproduce, publish, or commercially exploit the App's content, in whole or in part, without express written authorisation.
- Use automated tools, bots, scrapers, or scripts to interact with the App or extract data.
- Post inappropriate, defamatory, obscene, threatening, or offensive content in community forums.
- Impersonate other users, misrepresent your identity, or create multiple accounts.
- Interfere with or disrupt the App's servers, networks, or infrastructure.
- Collect or harvest personal data of other users.
- Use the App's content for competing commercial services or products.
17. Copyright, Educational Use, and Takedown Process
We respect the intellectual property rights of authors, publishers, educators, and other rights holders. If you believe that any content available through the App, including without limitation any question, explanation, image, diagram, note, table, or other material, infringes your copyright or other proprietary rights, you may submit a takedown request through our dedicated Content Takedown Request page, or by sending a written complaint to [email protected].
Takedown SLA: We will acknowledge valid takedown requests within 24 hours and remove or disable access to reported content within 36 hours of verification.
To help us review your complaint promptly, please include the following details:
- Your full name, postal address, email address, and phone number.
- A description of the copyrighted work or proprietary material that you claim has been infringed.
- The exact location of the allegedly infringing material in the App, including the relevant URL, screen, question ID, topic name, screenshot, or any other identifying details.
- A statement that you have a good‑faith belief that the disputed use is not authorised by the rights owner, its agent, or the law.
- A statement that the information provided in your complaint is accurate and that you are the rights owner or are authorised to act on behalf of the rights owner.
- Your physical or electronic signature.
Mandatory: Proof of Ownership and Uniqueness
Under Section 13 of the Indian Copyright Act, 1957, copyright protection extends only to original creative expression — not to facts, ideas, concepts, common knowledge, or standard information. Medical education content, including clinical facts, diagnostic criteria, pharmacological data, anatomical descriptions, and examination-style questions, is inherently shared across thousands of textbooks, question banks, coaching materials, and educational platforms.
Accordingly, all takedown requests must be accompanied by:
- Proof of Ownership: Documentary evidence that the complainant is the original creator or authorised rights holder (e.g., copyright registration certificate, ISBN, publisher agreement, author contract, notarised declaration of authorship).
- Proof of Uniqueness: A signed declaration that the specific content is the complainant's original creative expression and does not appear in any other published book, question bank, coaching material, university examination paper, or educational platform. If the content is based on a standard medical fact, the complainant must explain how their specific expression is original rather than a mere statement of common knowledge.
- Declaration of Exclusivity: A signed statement under penalty of perjury confirming that identical or substantially similar content does not appear in any other published source, and acknowledging that filing a false or misleading takedown request may expose the complainant to liability under Section 66 of the Information Technology Act, 2000, and Sections 191, 193, and 196 of the Bharatiya Nyaya Sanhita, 2023.
Takedown requests that do not include the above documentation will be considered incomplete and will not be actioned. Full details and a structured email template are available on our Content Takedown Request page.
Upon receiving a sufficiently detailed complaint, we may review the reported content and may, where appropriate, remove, disable, restrict, or temporarily suspend access to the material while the matter is being assessed. We may also contact you for additional information or clarification before taking final action.
Counter-Notice
If you believe that content you posted or are associated with was wrongly removed or restricted as a result of a complaint, you may submit a written counter-notice to us at the same email address, including: (a) identification of the material that was removed and its location before removal; (b) a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification; (c) your name, address, and phone number; and (d) a statement that you consent to the jurisdiction of the courts at Amravati, Maharashtra, India. Upon receipt of a valid counter-notice, we may reinstate the material at our discretion.
We reserve the right to remove content, suspend access, or take other reasonable steps if we believe that any material may infringe third‑party rights, violate applicable law, or expose us to legal risk. Repeated or abusive infringement may lead to suspension or termination of access to the App or any associated account.
Nothing in this clause shall be interpreted as an admission that any particular content is infringing, nor does publication of educational material by itself create any waiver of rights.
18. User-Generated Content and Licence
The App may include community features such as forums and discussion boards where users can post content ("User Content"). By posting, submitting, or transmitting any User Content through the App, you grant Pre PG: MCQ Practice App a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sub-licensable licence to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from your User Content in connection with the operation and promotion of the App.
You represent and warrant that you own or have the necessary rights and permissions to post your User Content and to grant the above licence. You are solely responsible for the accuracy, legality, and appropriateness of your User Content. We do not endorse, verify, or assume liability for any User Content.
19. Intermediary Status, Safe Harbour, and Anonymous Contributions
The App functions as an intermediary platform within the meaning of Section 2(1)(w) of the Information Technology Act, 2000 ("IT Act"), providing technological infrastructure for the hosting, organisation, and presentation of educational content contributed by community members and users. We claim the benefit of the safe harbour provisions under Section 79 of the IT Act, as amended.
In accordance with these provisions:
- We do not initiate the creation of, select the receiver of, or substantively modify the educational content contributed by community members.
- Our role is limited to providing the technological platform, editorial arrangement, and organisational tools for educational content.
- We observe due diligence as prescribed under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as amended from time to time, including maintaining a grievance redressal mechanism and content reporting tools.
- Upon receiving actual knowledge of any content that is unlawful, infringing, defamatory, or otherwise objectionable, whether through a court order, government notification, or a valid complaint, we shall expeditiously remove or disable access to such content.
- We do not have independent knowledge of whether any particular question, answer, or explanation contributed by a community member infringes any third-party rights, and we do not undertake to verify the originality of each contribution.
Anonymous Contributions — No Contributor Data
All educational content on this platform is contributed anonymously. Our platform is designed with a privacy-by-design architecture that does not collect, store, track, or maintain any identifying information (including name, email, IP address, device identifier, or any other personal data) about content contributors at the time of contribution.
As a consequence:
- We do not have the technical capability to identify the contributor of any specific piece of content.
- We cannot provide contributor identity information in response to any request — whether from individuals, organisations, law enforcement, or legal authorities — because such data does not exist in our systems.
- Our response to valid complaints is limited to taking action on the content itself (removal, restriction, or modification) through our Content Takedown Request process.
Users and contributors acknowledge that the App is a platform for community-driven, anonymous educational content sharing, and that we bear no liability for the accuracy, originality, or legality of content contributed by community members, except to the extent required by applicable law. Each contributor is solely responsible for ensuring their submissions comply with all applicable laws, including copyright law.
20. Indemnification
You agree to indemnify, defend, and hold harmless Pre PG: MCQ Practice App, its founders, officers, employees, agents, licensors, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees and court costs) arising out of or relating to:
- Your use of or inability to use the App.
- Your violation of these Terms or any applicable law or regulation.
- Your infringement of any third-party intellectual property or other rights.
- Any User Content you post, submit, or transmit through the App.
- Your participation in the Test Series or any competitive feature.
- Any misrepresentation made by you.
- Any third-party claims arising from your actions or omissions.
This indemnification obligation shall survive the termination of your account and these Terms.
21. Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, software, compilation, and editorial arrangement thereof, are the property of Pre PG: MCQ Practice App or its licensors and are protected by applicable intellectual property laws, including the Copyright Act, 1957, the Trade Marks Act, 1999, and the Information Technology Act, 2000.
The App grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the App for your personal, non-commercial educational purposes only. This licence does not include the right to:
- Reproduce, distribute, or publicly display any content from the App.
- Create derivative works based on the App's content.
- Use the App for any commercial purpose without prior written consent.
Third-Party Image Credits, Attributions, and Fair Dealing
The App includes image-based medical questions featuring clinical photographs, radiological images (X-rays, CT scans, MRIs), histopathology slides, dermatological images, ECG tracings, and other medical imagery. These images are sourced from the following categories:
(a) Sources and Licensing
- Wikimedia Commons (commons.wikimedia.org) — a repository of freely licensed and public domain media files.
- Open-access medical journals and repositories — images published under open-access licences permitting educational reuse.
- Public domain medical atlases and government health publications — images in the public domain or published by government bodies for public educational use.
- Original content — images created, commissioned, or owned by Pre PG: MCQ Practice App.
Third-party images are used in accordance with their respective open licences, including but not limited to:
- Creative Commons Attribution-ShareAlike (CC BY-SA 2.0, 3.0, 4.0)
- Creative Commons Attribution (CC BY 2.0, 3.0, 4.0)
- Creative Commons Zero (CC0 1.0) — Public Domain Dedication
- Public Domain (including works where copyright has expired or been waived)
(b) Attribution and Compliance
We do not claim ownership of any third-party images. For each image used under a licence requiring attribution, the App displays the following information alongside or accessible from the image within the question interface:
- The name or pseudonym of the original author, photographer, or creator (where available).
- The applicable licence type (e.g., CC BY-SA 4.0).
- The source URL or repository reference.
All credits and attributions are preserved and displayed in compliance with the original licensing conditions. Where an image's licence requires that derivative works be shared under the same or compatible licence, we comply with such share-alike obligations to the extent applicable. If any attribution is found to be incomplete or inaccurate, we will correct it promptly upon notification.
(c) Fair Dealing Defence (Section 52 of the Copyright Act, 1957)
To the extent that any image used in the App is not covered by an open licence or public domain status, we rely upon the fair dealing provisions of Section 52(1)(a) and Section 52(1)(i) of the Indian Copyright Act, 1957, which permit the reproduction of copyrighted works for the purposes of private or personal use including research, and for the purpose of review, criticism, or educational instruction.
Our use of such images satisfies the fair dealing criteria because:
- Purpose: All images are used exclusively for non-commercial, educational, and self-assessment purposes — specifically to help medical students prepare for postgraduate entrance examinations.
- Nature of the work: The images depict medical, clinical, or scientific subject matter of factual character, which courts have consistently afforded a broader scope of fair dealing compared to creative or artistic works.
- Extent of use: Only individual images are used in the context of specific questions — not entire collections, textbooks, atlases, or publications.
- Effect on market: The use does not substitute for, compete with, or diminish the commercial market for the original work, as the images serve a supplementary educational function in a different medium and context.
(d) Medical Imagery Disclaimer
All clinical photographs, radiological images, histopathology slides, and other medical imagery displayed in the App are used strictly for educational and examination preparation purposes. These images must NOT be used for clinical diagnosis, treatment planning, patient care, or any real-world medical decision-making.
The images may have been resized, compressed, annotated, cropped, or otherwise adapted for the purpose of formulating examination-style questions. Such modifications may affect image quality and diagnostic accuracy. Users acknowledge that:
- The images are presented in an educational context and may not retain their original diagnostic resolution or fidelity.
- The accompanying question text and answer options reflect a pedagogical interpretation that may be simplified or adapted for examination purposes.
- We make no representation or warranty regarding the clinical accuracy, completeness, or diagnostic utility of any image.
- Any clinical interpretation of images within the App is the sole responsibility of the user and should not replace professional medical judgement.
(e) Limitation of Liability for Third-Party Images
While we exercise reasonable care in sourcing and attributing images, we do not independently verify the licensing status, provenance, chain of title, or copyright ownership of every image contributed to or used within the App. Accordingly:
- We make no warranty or guarantee that every third-party image used in the App is correctly licensed, accurately attributed, or free from third-party claims.
- We shall not be liable for any claim, loss, damage, or liability arising from the use, display, or reproduction of any third-party image, including claims of copyright infringement by third parties.
- Our total liability in respect of any image-related claim shall be limited to the prompt removal or replacement of the disputed image upon valid notification, as described in Section 17 (Copyright, Educational Use, and Takedown Process) of these Terms.
(f) User Acknowledgment Regarding Images
By using the App, you acknowledge and agree that:
- You understand that the App contains third-party images used under open licences and/or fair dealing provisions.
- You will not download, extract, redistribute, republish, or commercially exploit any images from the App without independently verifying and complying with the applicable licence terms.
- You accept that image availability, attributions, and associated content may change at any time without notice as part of our ongoing compliance efforts.
- You will not hold us liable for any inaccuracies in image attribution or any third-party claims arising from images displayed within the App.
(g) Image Takedown and Correction
If you are the copyright holder of any image used in the App and believe that your rights have been infringed, that the attribution is incorrect, or that the image is being used outside the scope of its licence, please contact us at [email protected] with the following details:
- Identification of the specific image(s) at issue (screenshot, question ID, or description).
- Evidence of your ownership or authorisation to act on behalf of the rights holder.
- The correct attribution information or the basis for your claim.
- A statement of good faith that the use is not authorised.
We will acknowledge your request within 24 hours and take appropriate action — including correction of attribution, replacement of the image, or removal — within 36 hours of verification. 22. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY.
We do not warrant that:
- The App will be uninterrupted, timely, error-free, or secure.
- The content is complete, accurate, reliable, or up-to-date for any examination purpose.
- Results obtained from the App, including test scores and rankings, will meet your specific requirements or expectations.
- Any defects in the App will be corrected.
- The App is free from viruses or other harmful components.
23. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PRE PG (DR SEWANI'S), ITS FOUNDERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:
- Any indirect, incidental, special, consequential, punitive, or exemplary damages.
- Loss of data, profits, revenue, business opportunities, or goodwill.
- Examination results, academic outcomes, or career consequences.
- Cost of procurement of substitute services.
- Any damages arising from unauthorised access to or alteration of your data.
- Any clinical, diagnostic, or therapeutic decisions made based on App content.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT, IF ANY, ACTUALLY PAID BY YOU TO US FOR ACCESS TO THE APP DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM. WHERE NO FEES HAVE BEEN PAID, OUR MAXIMUM LIABILITY SHALL BE LIMITED TO INR 100 (ONE HUNDRED RUPEES).
This limitation of liability applies regardless of the legal theory on which the claim is based, including negligence, breach of contract, tort, strict liability, or otherwise, and even if we have been advised of the possibility of such damages.
24. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Acts of God, natural disasters, epidemics, or pandemics.
- War, terrorism, civil unrest, or government actions.
- Strikes, labour disputes, or supply chain disruptions.
- Failure or unavailability of telecommunications, internet, or power infrastructure.
- Cyber attacks, distributed denial-of-service attacks, or data breaches by third parties.
- Changes in law, regulation, or government policy.
- Server failures, cloud service outages, or third-party service provider disruptions.
25. Dispute Resolution and Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by binding arbitration administered in accordance with the Arbitration and Conciliation Act, 1996, as amended.
The arbitration shall be conducted:
- By a sole arbitrator mutually appointed by the parties, or in the absence of agreement within thirty (30) days, appointed in accordance with the provisions of the Arbitration and Conciliation Act, 1996.
- In the English language.
- At Amravati, Maharashtra, India.
The arbitrator's award shall be final and binding on both parties and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own costs of arbitration unless the arbitrator orders otherwise.
Waiver of Class Action: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class action, collective action, or representative action. You waive any right to participate in or bring claims as a class member in any class or representative proceeding.
26. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Subject to the arbitration clause above, the courts at Amravati, Maharashtra, India, shall have exclusive jurisdiction over any disputes that are not subject to arbitration.
27. Modifications to the Service
We reserve the right to modify, update, suspend, or discontinue any part of the App, including content, features, question database, test schedules, scoring systems, or ranking methodologies, at any time, with or without notice. We shall not be liable for any modification, suspension, or discontinuance of the service.
28. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination:
- Your licence to use the App shall immediately cease.
- You must delete all copies of the App from your devices.
- Sections relating to intellectual property, indemnification, limitation of liability, arbitration, governing law, and the user content licence shall survive termination.
29. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
30. Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices or policies published by us on or through the App, constitute the entire agreement between you and Pre PG: MCQ Practice App regarding the use of the App and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
31. No Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us to be effective.
32. Assignment
You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. We may assign these Terms without restriction.
33. Changes to These Terms
We may revise these Terms at any time by updating this page. The "Last updated" date at the top of this page indicates when the Terms were last revised. Continued use of the App after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
